A Reference by the Attorney General for Northern Ireland of a devolution issue under paragraph 34 of Schedule 10 to the Northern Ireland Act 1998 [2026] UKSC 16 – ‘the AGNI judgment’
In June 2026 there was a judgment in the UK Supreme Court about the meaning of deprivation of liberty in health and social care settings. This initial briefing session is for care managers and is intended to achieve the following aims:
- To provide information about the key features of the AGNI judgment: valid consent and a multifactorial approach to noting deprivation of liberty
- To provide information about likely changes and differences between health and social care settings
- To provide information about local responses to the judgment
- To introduce local guidance and to consider the applicability of the judgment in practice scenarios
- To remind staff about which aspects of practice remain unchanged and to consolidate good practice
By the end of the course, the following objectives will be met:
- Staff will have a basic understanding of the main issues and have had an opportunity to ask key questions and discuss issues with peers
- Staff will be able to access to written guidance and other forms of support
- Staff will be familiar with proposed local responses
- Staff will be better equipped for undertaking routine practice (hospital discharges, emergency admissions to care homes, applications to the Court of Protection) within a changed legal framework
