    The session will provide an understanding of the following:

    •Placing the Mental Capacity Act 2005 (MCA) in context

    •Principles of the MCA (s1) and how to apply them in practice

    •The test for incapacity (ss2 & 3) – the legal test, how to apply it, the burden of proof, relevant information explained, practice points and dilemmas and recording requirements

    •Best interests (the law - s4, and case law)

    •Who is the decision maker?

    •Legal defense for actions (s5 MCA)

    •Lawful use of restraint and the limits to s6 MCA .
